About Elmen Legal and Cases I Accept
I am proud to be a Michigan criminal defense attorney.
When people ask “How can you defend ‘those people’?” I tell them that I am proud to stand up for the Constitution and the Bill of Rights, that I get to argue every day for the presumption of innocence, the right to trial by jury, and proving guilt beyond a reasonable doubt, and that my job is right there in the Sixth Amendment to the United States Constitution.
For my clients, who are facing the vast array of government resources whose goal is to find them guilty, I may be the only thing standing between them and a criminal conviction, jail time, and hefty fines.
Cases I Accept
I represent people who have been accused of all manner of crimes in and around Ann Arbor, Michigan. These include violent crimes, such as murder, assault, and kidnapping, sex crimes like rape, sexual assault, and internet sex crimes, theft crimes such as robbery, burglary, or fraud, and drug crimes like possession of drugs, distribution of a controlled substance, and driving under the influence of alcohol or drugs (DUI).
Violent Crimes
In Michigan, violent crimes include charges of murder, manslaughter, and crimes involving the use of a knife, firearm, or other deadly weapon. They also include charges of assault and domestic violence.
Assault charges usually arise from unexpected situation that turned bad. An argument escalated to a fight, police were called, and now you’re facing assault charges. Assault is a serious crime that carries serious consequences. You need an experienced Michigan criminal defense lawyer on your side. I can help.
Domestic Violence allegations are often accompanied by feelings of anger, frustration, and betrayal. Even if you believe the charges are baseless, this will not stop the prosecutor from pursuing a conviction. You need to take domestic violence seriously, and should contact an Ann Arbor criminal defense lawyer as soon as possible.
Sex Crimes
Allegations of Sexual Assault in Michigan or criminal sexual conduct (CSC) are serious and emotionally charged, and the stakes are high. Conviction for a Michigan sex crime can have life-changing consequences, including jail time, fines, probation, and registration as a sex offender.
If you have been charged with rape, child sexual abuse, any type of criminal sexual conduct, internet sex crimes, or prostitution, you need an experienced Michigan criminal defense lawyer who will fight for your rights.
Drug Crimes
A conviction for Michigan drug crime possession, even possession of marijuana that violates Michigan’s recreational drug laws, carries serious penalties. The severity of a drug crime charge often depends on the amount of drugs in your possession, but penalties could be as high as life in prison and a fine of up to $1,000,000.
If you are charged with possession of drugs with intent to sell or deliver, the consequences could be even worse as you face a minimum sentence of 20 years in prison.
Operating While Intoxicated (OWI/DUI)
You can be charged with Operating While Intoxicated (Michigan OWI / Drunk Driving) if you are unable to operate a motor vehicle because you are under the influence of alcohol or drugs. Conviction for a Michigan OWI carries serious penalties that can include jail time, fines, and a suspended license. Depending on your job, you may be facing the loss of your livelihood. Elmen Legal is here to help.
Theft Crimes
In Michigan Theft Crimes, there are two levels of felony theft, and two levels of misdemeanor theft. The severity of the penalties will depend on the value of goods or services that were stolen.
Penalties range from 93 days in jail and a fine of up to $500 for petty theft to up to 1 year in jail and a fine of up to $,2000 or three times the value of the goods stolen for second-degree misdemeanor theft.
If the value of the goods or services stolen is between $1,000 and $20,000, you face up to 5 years in prison and a fine of up to $10,000. For goods or services valued at more than $20,000, you face charges of second-degree felony theft that is punishable by up to 10 years in prison and a fine of $15,000 or three times the value of the property stolen.
